PRIVACY POLICY

This Privacy Policy describes how your personal information is collected, stored, used, and shared by Redmont Capital, LLC (“Redmont Capital”) and Redmont Capital Markets, LLC (“Redmont Capital Markets”), collectively referred to as “Redmont,” when you visit or make a purchase from redmontcapital.com (the “Site”).

PERSONAL INFORMATION WE COLLECT

When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information.”

Additionally when you submit a web form or attempt to submit a web form through the Site, we collect certain information from you, which may include your name, address, contact information (including email address and phone number), or company information (including company name, your role at the company, and your company’s website).  We refer to this information as “Request Information.”

When we talk about “Personal Information” in this Privacy Policy, we are talking both about Device Information and Request Information.

HOW DO WE USE YOUR PERSONAL INFORMATION?

We do not sell or otherwise disclose personal information about you except as described here or at the time of the collection. Redmont may share data in the following ways:

  • To contact you in response to questions or when otherwise necessary;

  • To complete transactions you have performed through Redmont;

  • To provide to Redmont third party vendors and/or affiliates that enable us to complete transactions you have performed through Redmont;

  • To cooperate with legal or regulatory authorities or pursuant to a court order or subpoena; and

  • To perform identity and address verification or enforce our legal rights.

We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address) and more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).

PERSONAL INFORMATION ABOUT CHILDREN

We do not knowingly collect or maintain personal information about children unless the personal information is provided by a parent, legal guardian or authorized adult. SHARING YOUR DEVICE INFORMATION

Finally, we may also share your Device Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.

Please note that we do not alter our Site’s data collection and use practices when we see a Do Not Track signal from your browser.

HOW LONG DO WE RETAIN YOUR PERSONAL INFORMATION FOR?

We retain your personal information in an identifiable form in accordance with our internal policies, which establish general standards and procedures regarding the retention, handling and disposition of your personal information. Your personal information is retained for as long as necessary to meet legal, regulatory and business requirements. Retention periods may be extended if we are required to preserve your personal information in connection with litigation, investigations and proceedings.

INTERNATIONAL DATA TRANSFERS

Redmont may transfer your personal information abroad if required for the permitted purposes as described above. We will ensure that any such international transfers out of the European Economic Area (EEA) are made subject to appropriate or suitable safeguards as required by the GDPR or other relevant laws.

YOUR RIGHTS

If you are a European resident, you have legal rights under the General Data Protection Regulation (EU) 2016/679 (“GDPR”) in relation to the personal information that we hold about you. These rights include:

  • Obtaining information regarding the processing of your personal information and access to the personal information that we hold about you. Please note that there may be circumstances in which we are entitled to refuse requests for access to copies of personal information. In particular, information that is subject to legal professional privilege;

  • Requesting that we correct your personal information if it is inaccurate or incomplete;

  • Requesting that we erase your personal information in certain circumstances. Please note that there may be circumstances where you ask us to erase your personal information but we are legally entitled to retain it;

  • Objecting to, and requesting that we restrict, our processing of your personal information in certain circumstances. Again, there may be circumstances where you object to, or ask us to restrict, our processing of your personal information but we are legally entitled to refuse that request;

  • Withdrawing your consent, although in certain circumstances it may be lawful for us to continue processing without your consent if we have another legitimate reason (other than consent) for doing so.

Additionally, if you are a European resident we note that we are processing your information in order to fulfill contracts we might have with you (for example if you request contact through the Site), or otherwise to pursue our legitimate business interests listed above.  Additionally, please note that your information will be transferred outside of Europe, including to Canada and the United States.

UPDATING YOUR PERSONAL INFORMATION
